1. Current status and agreement
These Terms form an agreement between you and Hongyu Zhang, an individual who operates the NextTongue product. In these Terms, “NextTongue,” “we,” “us,” and “our” refer to Hongyu Zhang. NextTongue is a product name and is not a separate legal entity.
NextTongue is currently in development and is not yet publicly available on the App Store. Website information may describe the planned first release. Subscription provisions in these Terms become applicable only when an eligible subscription is offered through Apple.
By using this website or the released app, you agree to these Terms. If you do not agree, do not use the service. Use of the iPhone app is also subject to Apple’s applicable terms, including the Apple Standard End User License Agreement.
2. Eligibility and launch scope
NextTongue is intended for adults age 18 or older. The planned first release is for compatible iPhones in the United States, with US English as the learning target. It is not designed for Android, iPad, Mac, or other platforms at launch.
You need an Apple Account and a compatible iPhone configuration to obtain the app and, if offered, purchase a subscription through the App Store.
3. What NextTongue provides
NextTongue organizes a language practice built around one short, complete, everyday sentence that you choose in your native language. The app uses available iPhone system capabilities to produce one US English target sentence and guide repeated listening, speaking, handwriting, and scheduled review.
The service is a learning-management and practice tool. It does not provide a comprehensive language course, professional translation service, pronunciation certification, tutoring relationship, emergency service, or open-ended conversation system.
4. Important limitations
Do not use the service for medical, legal, financial, emergency, professional, safety-critical, or other high-risk communication. Use qualified professional assistance for those purposes.
Translation, speech recognition, speech synthesis, and handwriting input depend on Apple system capabilities. Availability and behavior may vary with iPhone model, iOS version, region, language resources, permissions, settings, network conditions, and Apple services. NextTongue may pause learning when a required capability is unavailable.
A system-generated translation may not be the only possible way to express an idea. NextTongue presents one target sentence for focused beginner practice; it does not promise that the sentence is appropriate for every context or every intended meaning.
5. Subscription, free trial, and billing
The planned first release uses one annual auto-renewable subscription purchased through Apple. The current localized price, renewal period, and any eligible introductory offer will be displayed by Apple before you confirm the purchase. NextTongue does not hard-code a price on this website.
Introductory offer
An eligible customer may receive a one-month introductory free trial with the annual subscription. One App Store month may contain 28, 29, 30, or 31 days. Apple determines eligibility based on the subscription group and prior offer use. If Apple reports that you are not eligible, NextTongue does not create a separate local free period.
Automatic renewal
The subscription renews automatically according to Apple’s purchase terms unless you cancel through your Apple Account. Canceling automatic renewal does not end access before the current verified subscription period expires. Learning access requires a current verified entitlement and compatible system capabilities.
Manage, cancel, or request a refund
Apple determines refund eligibility and outcomes. NextTongue support cannot approve an Apple refund or ask you for an Apple Account password, verification code, or complete payment information.
6. Learning records and restoration
The planned first release stores learning records only on the current iPhone. It does not provide cloud backup, synchronization, export, device migration, or reinstall recovery for learning records.
Deleting the app, losing or changing the iPhone, or reinstalling may permanently remove those records. Restoring purchases restores an eligible Apple subscription entitlement only; it does not restore learning records.
You may delete individual sentences or all NextTongue learning records from within the app. Apple purchase and subscription records remain controlled by Apple. See the Privacy Policy for more information.
7. Acceptable use
You agree not to:
- use NextTongue for unlawful, abusive, harmful, or fraudulent activity;
- attempt to bypass subscription, compatibility, safety, or data-deletion controls;
- reverse engineer, interfere with, overload, or disrupt the website or app except where applicable law expressly permits;
- misrepresent NextTongue output as professional advice, certified translation, or an emergency service;
- infringe intellectual property, privacy, or other rights.
8. Ownership and feedback
The NextTongue product name, website, app design, original text, graphics, and software are owned by Hongyu Zhang or used under license and are protected by applicable intellectual-property laws. These Terms grant only a limited, personal, non-transferable right to use the released app as permitted by the App Store license.
You keep your rights in the sentences you enter. Providing feedback does not give NextTongue ownership of your learning content. If you voluntarily provide product feedback that does not include learning content or confidential information, you permit us to use it to improve the service without payment or attribution.
9. Disclaimers and limits of liability
To the maximum extent permitted by applicable law, the website and app are provided “as is” and “as available.” We do not guarantee uninterrupted availability, permanent compatibility with every device or language combination, error-free system translation or recognition, or a particular learning result.
To the maximum extent permitted by applicable law, Hongyu Zhang, operating the NextTongue product, will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of learning records, opportunity, revenue, or data arising from use of or inability to use the service. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.
10. Changes, suspension, and termination
We may change the website, update the app, correct errors, suspend affected functions, or discontinue compatibility where required for safety, law, Apple platform changes, or reliable operation. Material changes to these Terms will be identified by an updated date and, when appropriate, an additional notice.
You may stop using the service at any time. Canceling a subscription and deleting learning records are separate actions.
